[673] Bhikkhus, if those bhikkhus are not able to settle that legal issue (adhikaraṇa) in that residence (āvāsa), then, bhikkhus, those bhikkhus should go to a residence where there are more bhikkhus. If, bhikkhus, while those bhikkhus are going to that residence, they are able to settle that legal issue along the way, this, bhikkhus, is called a legal issue that has been settled. Settled by what? By resolution in the presence (sammukhāvinaya). And what is there in that resolution in the presence? Presence of the Saṅgha, presence of the Dhamma, presence of the Vinaya, presence of the persons.
And what therein is presence of the Saṅgha? As many bhikkhus as are entitled to take part in the formal act (kamma) have come; the consent (chanda) of those entitled to give consent has been conveyed; and those present face to face do not protest — this therein is presence of the Saṅgha.
And what therein is presence of the Dhamma and presence of the Vinaya? The Dhamma, the Vinaya, and the Teacher's instruction by which that legal issue is settled — this therein is presence of the Dhamma and presence of the Vinaya.
And what therein is presence of the persons? The one who disputes and the one with whom he disputes — both opponents in the matter are present face to face — this therein is presence of the persons.
Bhikkhus, if, when a legal issue has been settled in this way, one who took part reopens it, the reopening is an offense of pācittiya; if one who gave consent complains, the complaining is an offense of pācittiya.
