[105] **Water** means: water contained in a vessel, or in a lotus pond, or in a reservoir.
If, with the intention to steal (theyyacitta), he touches it, he commits an offense of wrong-doing (dukkaṭa). If he makes it stir, he commits a grave offense (thullaccaya). If he moves it from its place, he commits an offense entailing expulsion (pārājika).
If, having inserted his own vessel, he touches, with the intention to steal, water worth five māsakas or more than five māsakas, he commits an offense of wrong-doing. If he makes it stir, he commits a grave offense. If he makes it enter his own vessel, he commits an offense entailing expulsion.
If he breaches an embankment (mariyāda), he commits an offense of wrong-doing. If, having breached the embankment, he lets out water worth five māsakas or more than five māsakas, he commits an offense entailing expulsion. If he lets out water worth more than one māsaka but less than five māsakas, he commits a grave offense. If he lets out water worth one māsaka or less than one māsaka, he commits an offense of wrong-doing.
