Mohanasikkhāpada

[726] There is no offense: for one who criticizes one acting habitually out of desire (chanda), hatred, delusion, or fear, saying, "What is the use of what is given to him? Even having received it, he will squander it; he will not put it to proper use"; for one who is insane; for the first offender.
