[1059] On whatever occasion a legal issue (adhikaraṇa) is settled by resolution in the presence (sammukhāvinaya) together with the verdict of mindfulness (sativinaya): where there is the verdict of mindfulness, there is resolution in the presence; where there is resolution in the presence, there is the verdict of mindfulness; but there is no verdict of past insanity (amūḷhavinaya) there, no acting upon acknowledgment (paṭiññātakaraṇa) there, no decision by majority (yebhuyyasikā) there, no verdict of aggravated misconduct (tassapāpiyasikā) there, no covering over with grass (tiṇavatthāraka) there.
