[360] Now at that time the Venerable Channa, being examined in the midst of the Saṅgha concerning an offense (āpatti), thinking, "If I evade by dodging one thing with another, I shall fall into an offense," became silent and vexed the Saṅgha. Those bhikkhus who were of few wishes … criticized, complained, and spread it about, saying: "How can the Venerable Channa, being examined in the midst of the Saṅgha concerning an offense, remain silent and vex the Saṅgha?" Then those bhikkhus reported this matter to the Blessed One. … Then the Blessed One questioned the Venerable Channa: "Is it true, as they say, Channa, that you, being examined in the midst of the Saṅgha concerning an offense, remained silent and vexed the Saṅgha?"
"It is true, Blessed One."
The Buddha, the Blessed One, rebuked him: "How can you, foolish man, being examined in the midst of the Saṅgha concerning an offense, remain silent and vex the Saṅgha? This, foolish man, is not for the confidence of those without confidence …" Having rebuked him and given a talk on the Dhamma, he addressed the bhikkhus: "Well then, bhikkhus, let the Saṅgha impose a charge of vexation (vihesaka) upon the bhikkhu Channa. And thus, bhikkhus, should it be imposed: the Saṅgha should be informed by a competent and capable bhikkhu:
"'Venerable sirs, let the Saṅgha listen to me. This bhikkhu Channa, being examined in the midst of the Saṅgha concerning an offense, has become silent and vexes the Saṅgha. If it is the right time for the Saṅgha, let the Saṅgha impose a charge of vexation upon the bhikkhu Channa. This is the motion (ñatti).
"'Venerable sirs, let the Saṅgha listen to me. This bhikkhu Channa, being examined in the midst of the Saṅgha concerning an offense, has become silent and vexes the Saṅgha. The Saṅgha imposes a charge of vexation upon the bhikkhu Channa. Any venerable one to whom the imposing of the charge of vexation upon the bhikkhu Channa is agreeable should remain silent; any to whom it is not agreeable should speak.
"'The charge of vexation has been imposed by the Saṅgha upon the bhikkhu Channa. It is agreeable to the Saṅgha; therefore it is silent. Thus do I hold it.'"
