[614] Now at that time the bhikkhu Upavāḷa, being examined about an offence (āpatti) in the midst of the Saṅgha, having denied it, admitted it; having admitted it, denied it; evaded one question with another; and spoke deliberate falsehood. Those bhikkhus who were of few wishes … were annoyed, criticized, and spread it about, saying: "How can the bhikkhu Upavāḷa, being examined about an offence in the midst of the Saṅgha, having denied it, admit it; having admitted it, deny it; evade one question with another; and speak deliberate falsehood?" Then those bhikkhus reported this matter to the Blessed One. "Is it true, as they say, bhikkhus …?" "It is true, Blessed One." … Having rebuked him and given a talk on the Dhamma, he addressed the bhikkhus: "Well then, bhikkhus, let the Saṅgha carry out the act of pronouncing aggravated misconduct (tassapāpiyasikā-kamma) against the bhikkhu Upavāḷa.
"And thus, bhikkhus, should it be done: First the bhikkhu Upavāḷa should be accused; having been accused, he should be made to recall; having been made to recall, the offence should be laid upon him; having laid the offence upon him, the Saṅgha should be informed by an experienced and competent bhikkhu:
"'Venerable sirs, let the Saṅgha hear me. This bhikkhu Upavāḷa, being examined about an offence in the midst of the Saṅgha, having denied it, admits it; having admitted it, denies it; evades one question with another; and speaks deliberate falsehood. If it is the proper time for the Saṅgha, let the Saṅgha carry out the act of pronouncing aggravated misconduct against the bhikkhu Upavāḷa. This is the motion (ñatti).
"'Venerable sirs, let the Saṅgha hear me. This bhikkhu Upavāḷa, being examined about an offence in the midst of the Saṅgha, having denied it, admits it; having admitted it, denies it; evades one question with another; and speaks deliberate falsehood. The Saṅgha carries out the act of pronouncing aggravated misconduct against the bhikkhu Upavāḷa. If the carrying out of the act of pronouncing aggravated misconduct against the bhikkhu Upavāḷa is agreeable to any venerable one, let him be silent; to whomever it is not agreeable, let him speak.
"'A second time I declare this matter. … A third time I declare this matter. …
"'The act of pronouncing aggravated misconduct against the bhikkhu Upavāḷa has been carried out by the Saṅgha. It is agreeable to the Saṅgha; therefore it is silent. Thus do I hold it.'"
