[92] Bhikkhus, an act of banishment (pabbājanīyakamma) possessed of three further factors … it is done in the absence [of the accused], it is done not in accordance with the Dhamma, it is done by an incomplete assembly (vagga). Bhikkhus, an act of banishment possessed of these three factors … it is done without interrogation, it is done not in accordance with the Dhamma, it is done by an incomplete assembly … it is done without [the accused's] acknowledgement, it is done not in accordance with the Dhamma, it is done by an incomplete assembly … it is done when there is no offence, it is done not in accordance with the Dhamma, it is done by an incomplete assembly … it is done for an offence not entailing confession, it is done not in accordance with the Dhamma, it is done by an incomplete assembly … it is done for an offence already confessed, it is done not in accordance with the Dhamma, it is done by an incomplete assembly … it is done without having accused [him], it is done not in accordance with the Dhamma, it is done by an incomplete assembly … it is done without having reminded [him], it is done not in accordance with the Dhamma, it is done by an incomplete assembly … it is done without having charged [him] with the offence, it is done not in accordance with the Dhamma, it is done by an incomplete assembly. Bhikkhus, an act of banishment possessed of these three factors is an act not in accordance with the Dhamma, an act not in accordance with the Vinaya, and one that is badly settled.
The twelve [triads] on the act not in accordance with the Dhamma are finished.
