[256] A bhikkhu who, taking hold of some point of a legal issue (adhikaraṇa) belonging to a different category as a mere pretext, charges (accuses) a bhikkhu with an offense entailing defeat (pārājika dhamma), falls into three offenses: not having had leave granted, he speaks intending to make him fall away — an offense of wrong-doing (dukkaṭa) together with the saṅghādisesa; having had leave granted, he speaks intending to abuse — an offense of insulting speech (omasavāda).
