[223] Now at that time the bhikkhus of Āḷavī, doing building work (navakamma), were cutting down a tree. A certain bhikkhu said to another bhikkhu, "Friend, stand here and cut." As he stood there cutting, the tree fell upon him and killed him. He was remorseful (kukkucca). … "There is no offense (āpatti), bhikkhu, for one not intending death."
Now at that time the bhikkhus of Āḷavī, doing building work, were cutting down a tree. A certain bhikkhu, intending death, said to another bhikkhu, "Friend, stand here and cut." As he stood there cutting, the tree fell upon him and killed him. … The tree fell upon him but did not kill him. He was remorseful. … "There is no offense of pārājika, bhikkhu; there is an offense of thullaccaya."
